Governing law

These terms are governed by Dutch law.

Reisplanner Terms

1. Who we are and when these terms apply

1.1 Reisplanner (www.reisplanner.app) is a product of ShipDocs, Middelweg 211, 1911 EE Uitgeest, the Netherlands. Chamber of Commerce (KvK) 95207341, VAT NL005138041B29, info@shipdocs.app, +31 20 369 5765.

1.2 These terms apply to all use of Reisplanner: with or without an account, free or with Pro. The general ShipDocs website terms also apply. If they conflict, these Reisplanner terms prevail.

1.3 You are shown these terms and must accept them before you create an account or take out Pro. You can save and print them (Art. 6:234(1) Dutch Civil Code, "BW"). After taking out Pro you also receive them by email. On request we send them to you free of charge.

2. Business user or consumer

2.1 You use Reisplanner as a consumer if you are a natural person not acting for your business or profession. Otherwise you use Reisplanner as a business user, for example as an owner-operator, shipping company or charterer.

2.2 Provisions that apply only to consumers or only to business users are marked as such. Nothing in these terms limits the rights you have as a consumer under the law.

3. Free and Pro

3.1 Free, without an account: planning routes, using the waterway guide and printing a limited number of voyage plans with a watermark.

3.2 Free, with an account: in addition, saving trips and opening them on any device, keeping your vessel profile and preferences, and printing voyage plans without a watermark.

3.3 Pro: in addition, exporting routes as an RTZ file (IEC 61174) for import into ECDIS. If we extend Pro, this will be shown on the Pro page.

3.4 Reisplanner is an online service: a digital service within the meaning of Art. 7:50aa(b) BW. You have access as long as your account (and for Pro: your subscription) runs.

4. Account

4.1 You provide correct details and keep your password and API tokens secret. If you notice misuse, report it immediately via info@shipdocs.app.

4.2 If you give a program or AI assistant access to your account (API token), that program acts on your behalf and you are responsible for what it does with your account. You can revoke access at any time in your profile.

4.3 You may not use Reisplanner in a way that harms the service or others, such as automated bulk data retrieval outside the API, circumventing security or reselling the service.

4.4 In the event of serious or repeated misuse we may block your account after a warning. If immediate action is needed, for example during an attack, we may do so without warning. We then end any running Pro subscription immediately and refund what you paid in advance for the period after that.

5. Pro trial period

5.1 New Pro users get a 14-day trial period. At the start you pay a one-off €0.01 (including VAT) with the payment method you have chosen (processed by our payment service provider Mollie; see 6.3). The trial period starts once that payment has succeeded. You get the trial period once per user.

5.2 After the trial period, Pro automatically continues as a paid monthly subscription (price: see 6.1), unless you cancel before the end of the trial period. We collect the first month on the day after the trial period ends. The end date of your trial period is shown in the confirmation email and in your profile.

5.3 4 days before the first charge (3 days before the last day of your trial) we send you a reminder by email, with the date and amount of the first charge and a link to cancel.

5.4 If you cancel during the trial period, we collect nothing further. You keep Pro until the end of the trial period.

6. Price and payment

6.1 The price of Pro per month:

  • Consumers in the European Union: €6.05 including 21% VAT.
  • Business users in the Netherlands: €5 excluding VAT, plus 21% VAT (€6.05 in total).
  • Business users in another EU country with a valid VAT number: €5, without Dutch VAT. VAT is reverse charged to you as the customer: you account for the VAT in your own country (Arts. 44 and 196 VAT Directive 2006/112/EC; Art. 6(1) Dutch VAT Act 1968). When you sign up, we check your VAT number in VIES, the European Commission's VAT system. You warrant that the VAT number is correct, belongs to your business and that you take out Pro for your business. If VIES shows the number as invalid, or we cannot check it when you sign up (for example because VIES is unavailable), the Dutch rate applies (€5 plus 21% VAT), and it stays that way for that subscription. If you later want to subscribe without Dutch VAT, email info@shipdocs.app. If your VAT number later turns out to be invalid or incorrect, we may charge Dutch VAT for the months concerned after the fact.

The current price is always shown on the Pro page and when you sign up; for consumers always including VAT.

6.1a Who can subscribe to Reisplanner Pro

1. Reisplanner Pro is available to consumers residing in a member state of the European Union and to businesses established in a member state of the European Union.

2. Consumers residing outside the European Union and businesses established outside it cannot currently subscribe to Reisplanner Pro. This also applies to Norway, Iceland, Liechtenstein, Switzerland and the United Kingdom.

3. When subscribing, you indicate whether you are ordering as a consumer or as a business and in which country you reside or are established. You warrant that these details are correct. If it later turns out that you reside or are established outside the European Union, we may terminate the subscription. Any amounts already paid for the current period will then be refunded pro rata.

6.2 You pay through our payment service provider Mollie B.V., using one of the payment methods offered at checkout, for example iDEAL or a credit card. With the first payment you authorise us to charge the subscription fee automatically every month after that: after a first payment with iDEAL or a similar bank method as a recurring SEPA direct debit, and otherwise via the payment method you used the first time.

6.2a Pre-notification of charges. For a SEPA direct debit the standard pre-notification period is 14 calendar days. You agree with us that this period is at least 3 calendar days. The following count as pre-notification: the confirmation email after signing up (stating the monthly amount and the charge day, for all monthly charges of the same amount) and, with a trial period, the reminder email 4 days before the first charge. If you take out Pro without a trial period and we charge immediately, your order counts as pre-notification of that first charge. If the amount changes, you will be notified at least 30 days in advance (6.5).

6.3 The €0.01 payment (including VAT) at the start of the trial period is needed to verify your payment method and record your authorisation for the monthly charge. This amount is not refunded, unless you withdraw (Article 8).

6.4 If a charge fails, you keep access for 5 more days and we email you. If you do not arrange payment, Pro stops; your account and the free features remain. If a payment is collected by SEPA direct debit, you can have it reversed by your bank within eight weeks, without giving a reason, under the rules of the European direct debit scheme (Art. 76(1), fourth subparagraph, and Art. 77 of Directive (EU) 2015/2366). If you did not authorise a debit, tell your bank as soon as possible and no later than thirteen months after the debit (Art. 7:526 Dutch Civil Code). A reversal does not cancel Pro; you do that yourself (article 7). For other payment methods, the rules of the provider apply, such as your card issuer. Your statutory rights remain unaffected.

6.5 Price change: we announce a new price at least 30 days in advance by email. If you do not agree, you can cancel free of charge before the new price takes effect. We do not increase the price in the first three months after you sign up (Art. 6:236(i) BW).

6.6 Invoices. After each paid month you automatically receive an invoice by email, at the email address stored with your billing address when you signed up (your account's email address at that time), no later than the 15th day of the month following the charge. This applies to consumers and business customers. The invoice is created and sent on behalf of ShipDocs by our payment service provider Mollie. The invoice shows the billing address you enter when you sign up; if you sign up as a business, also your company name and your VAT number or company registration number. If VAT is reverse charged (6.1), the invoice shows your VAT number, our VAT number and the statement "Reverse charge" (on a Dutch invoice "btw verlegd", on a German one "Steuerschuldnerschaft des Leistungsempfängers"), without Dutch VAT. We do not issue an invoice for the €0.01 payment at the start of the trial period. If your billing address is no longer correct, email info@shipdocs.app. We only issue invoices to customers in the European Union (see Article 6.1a).

7. Term and cancellation

7.1 Pro is a monthly subscription for an indefinite period with no minimum term. You can cancel at any time with a notice period of no more than one month (Art. 6:236(j) BW): after cancellation we collect nothing further and you keep Pro until the end of the month you have already paid for.

7.2 You cancel online, in your profile under Subscription, with the "Cancel subscription" button. Emailing info@shipdocs.app also works (Art. 6:236(o) BW). You receive a confirmation by email.

7.3 You can have your account deleted at any time. If you still have Pro, we cancel it at the same time.

7.4 We can terminate Pro with at least one month's notice. If we stop Reisplanner altogether, we will announce this at least three months in advance and you can request your saved trips from us before then.

8. Right of withdrawal (consumers only)

8.1 If you take out Pro as a consumer, you can withdraw from the contract within 14 days without giving any reason. The period starts on the day after the day you take out Pro (Art. 6:230o(1)(a) BW).

8.2 You can withdraw:

  • with the "Withdraw from contract" button in your profile under Subscription (Art. 6:230oa BW). You enter your name, select the contract and confirm with "Confirm withdrawal";
  • or by email to info@shipdocs.app, for example using the model form below (Art. 6:230o(3) BW).

You immediately receive an acknowledgement of receipt by email, with the content of your statement and the date and time you submitted it. You are on time if you send your statement before the 14 days have expired.

8.3 When you sign up we expressly ask whether Pro may start immediately, within the withdrawal period (Art. 6:230v(8) BW). If you then withdraw:

  • you only owe an amount proportionate to the part of the service already provided (Art. 6:230s(4) BW): the monthly price × the number of days you had Pro / the number of days in that month. For a subscription with a trial period this is always €0;
  • we refund what you paid, minus that proportionate amount, within 14 days using the same means of payment (Art. 6:230r BW). With a trial period you therefore get everything back, including the €0.01.

8.4 Your right of withdrawal only lapses once the service has been fully performed (Art. 6:230p(d) BW). With a monthly subscription that does not happen within 14 days, so you keep the full right of withdrawal during that period.

8.5 The right of withdrawal applies once, when you sign up. When the trial period turns into the paid subscription, or the subscription enters a new month, no new right of withdrawal arises (CJEU 5 October 2023, C-565/22, Sofatutor, ECLI:EU:C:2023:735). You can always cancel (Article 7).

8.6 After withdrawal you no longer use Pro (Art. 6:230s(7) BW).

8.7 If you use Reisplanner as a business user, you have no statutory right of withdrawal. If you email us within 14 days of signing up, we will handle your request in the same way as a goodwill gesture.

9. What you can expect (conformity)

9.1 We provide Reisplanner in its most recent version and ensure that the service works properly and securely.

9.2 Consumers: Reisplanner must conform to the contract. If it does not, you have the statutory remedies: bringing into conformity, price reduction or termination (Art. 7:50ad, 7:50ae and 7:50ai BW). We do not deviate from these rights (Art. 7:50ap BW). Report a defect via info@shipdocs.app.

9.3 We may modify and improve Reisplanner. If a modification goes beyond what is needed to keep the service in conformity and has more than a minor negative impact on you as a consumer, we notify you in advance by email and you can terminate Pro free of charge within 30 days (Art. 7:50al BW).

10. Navigation: the skipper remains responsible

10.1 Reisplanner is a planning aid. It is not a means of navigation and does not replace ECDIS or Inland ECDIS, official electronic navigational charts (ENC), Notices to Skippers (NtS), VHF and VTS information, or the Dutch Inland Navigation Police Regulations (Binnenvaartpolitiereglement), the Rhine Navigation Police Regulations and other applicable navigation rules.

10.2 Data on routes, water levels, tides, discharge, clearance heights, operating hours, VHF channels, weather, voyage times, consumption and CO₂ come partly from third parties (such as Rijkswaterstaat, EuRIS, vaarweginformatie.nl, MarinePlan, MET Norway and OpenStreetMap) and are estimates or snapshots. They may be incomplete, delayed or incorrect.

10.3 You check all information yourself against official sources. The skipper always remains responsible for voyage preparation and safe navigation. Check an RTZ export before using it in ECDIS.

11. Availability

11.1 We aim for Reisplanner to be available at all times, but do not guarantee uninterrupted operation. We carry out maintenance outside busy hours as far as possible.

11.2 If Pro does not work as agreed, as a consumer you have the rights in Article 9.2.

12. Liability

12.1 Business users: our liability is limited to direct damage and, per event (a series of related events counts as one), to the lower of these amounts: what you paid for Pro in the 12 months before the event, or €500. If you only use the free features, our liability is limited to €100. We are not liable for indirect damage, such as consequential loss, lost profit, delay, berth dues, demurrage or damage to vessel or cargo. These limitations do not apply in the event of intent or deliberate recklessness on the part of ShipDocs or its management.

12.2 Consumers: we are liable in accordance with the law. This also applies to damage caused by your use of information from Reisplanner; if you do not follow Article 10, this may count as contributory fault under the law (Art. 6:101 BW).

12.3 These limitations never apply to damage caused by death or personal injury.

13. Intellectual property

13.1 The software, texts and design of Reisplanner belong to ShipDocs or our licensors. You receive a personal, non-transferable right to use Reisplanner in accordance with these terms.

13.2 Map data © OpenStreetMap contributors (ODbL); weather data: MET Norway (CC BY 4.0).

13.3 What you enter, such as routes and vessel details, remains yours. We only use it to provide the service (see the privacy statement).

14. Changes to these terms

14.1 We may change these terms. We announce important changes at least 30 days in advance by email. If you do not agree, you can cancel free of charge before the change takes effect. Changes do not apply retroactively.

15. Applicable law and disputes

15.1 These terms and the use of Reisplanner are governed by Dutch law. If you are a consumer habitually resident in another country, you also keep the protection of the mandatory rules of the law of that country (Art. 6(2) Rome I Regulation).

15.2 Business users: disputes are settled exclusively by the District Court of North Holland (rechtbank Noord-Holland).

15.3 Consumers living in the Netherlands: we may submit a dispute to the District Court of North Holland. You may then, within one month after we have invoked this provision in writing, choose the court that has jurisdiction under the law (Art. 6:236(n) BW). If you start proceedings, you can always go to the court that has jurisdiction under the law.

15.4 Consumers living in another EU country: Article 15.3 does not apply. You can bring proceedings against us in the courts of the country where you live or in the Dutch courts; we can only bring proceedings against you in the courts of the country where you live (Art. 18 Brussels I bis Regulation). If you live in Switzerland, Norway or Iceland, the same applies under the Lugano Convention.

15.5 If you have a complaint, please email info@shipdocs.app first. We acknowledge your complaint within 3 working days and respond in substance within 14 days.
